Harmonizing Moroccan Laws with International Human Rights Laws




Introduction

This study, commissioned by the Adala Association in partnership with the Friedrich Ebert Foundation, seeks to identify points and directions for the harmonization of national laws with international instruments of human rights that have been ratified by Morocco.

To this end, the study has engaged in the analysis of normative demand and offer in terms of harmonization, through the identification of demands on harmonization as expressed by stakeholders who participated in the process of consultation on the constitution and the evaluation of the solution brought by the constituent in terms of harmonization as well as interpretation challenges posed by the constitutionalization of the relative impact of international conventions on the internal legal order.

To define priorities in terms of harmonization, the study has conducted a mapping of different recommendations issued by bodies of the treaties, as well as those expressed within the framework of the Universal Periodic Review.

The study also offers suggestions for the development of a road map for the harmonization of Moroccan law with international human rights laws. These suggestions focus on two crucial aspects: the criteria to take into consideration for the development of a road map for the harmonization of Moroccan law with the international human rights laws and the design of a normative production cycle that is conducive to harmonization on the basis on the possibilities provided within the current constitutional framework.
